In allowing the enforceability of the prenup in the case, the three-judge appeals court nevertheless indicated little inclination to give weight to agreements regarding wife maintenance and child support, care, custody and control. The distintion is important. Statutory protection of the vulnerable thus remains undisturbed, even as the judges upheld a lower court’s judgement not to divide the divorcing couple’s matrimonial assets.
